Since 1989, Brancart & Brancart has been litigating housing discrimination cases on behalf of plaintiffs in federal and state court. Brancart & Brancart is dedicated to promoting enforcement of the federal Fair Housing Act and related state laws through litigation and public service, and by providing education, training and support to fair housing attorneys and advocates throughout the country. Currently, the firm handles more federal fair housing cases than any other law firm in the country, except for the Civil Rights Division of the United States Department of Justice. The firm consists of three attorneys and three support staff members.
Over the past 15 years, Brancart & Brancart has settled over 100 and tried 12 fair housing cases. The firm is currently handling approximately 40 other fair housing cases in the United States District Courts for the Central, Northern and Eastern Districts of California, the District of Nevada, the District of North Dakota. The firm has been counsel of record in several published decisions at the Ninth Circuit, all of which have addressed important issues in fair housing. The firm also represents housing discrimination complainants at the California Department of Fair Employment and Housing and the United States Department of Housing and Urban Development. Brancart & Brancart accepts cases by referral only from fair housing agencies, civil rights organizations, the United States Department of Justice, and other state and local agencies. The firm does not accept payment from its clients, most of whom are low income, but rather receives its attorneys' fees according to fee shifting statutes under the federal Fair Housing Act and other civil rights laws.
The firm's active fair housing cases involve issues of discrimination on the basis of race, national origin, familial status, disability, and gender, including sexual harassment, representing individuals who have been the victims of housing discrimination as well as non-profit fair housing organizations.. The firm also handles discriminatory lending cases. Brancart & Brancart also manages class action lawsuits. Currently, the firm represents female inmates in the North Dakota prison system in a class action alleging that the Department of Corrections violated equal protection laws based on gender.
